Yes, I think my concern is that, amongst other things,Oracle seem to be trying
to confuse the jury with the fact that a license is required for the TDK and to
officially call your implementation "Java", and the fact that the API
is from Harmony which requires no such license.

Is the jury capable of understanding the distinction?

Is the jury up to the task and what is a 'matter of law'?

Judge Alsup acts as if the question of whether "API's are
copyrightable" is a matter of law that he will have to decide, not the
jury. I assume that's one reason he is personally involved in asking questions
about exactly what an "API" is (see the first part of the Bloch
testimony). Sorry if the judge's statements to that effect don't appear in the
transcript, but there's only so much you can do if you're not a trained legal
reporter :-)
