will make a big difference,
but still.
While the jury cannot
unhear it, I think the Judge's words will have the effect of turning this into a
negative for Oracle. The judge has made clear to the jury that the "big number"
is unrelated to the case. The jury will remember that and it will have the
effect of making them sceptical about any big number that comes up. Certainly if
I was on the jury I would pay special attention to everything the judge says
because he's basically the only person I can trust in the courtroom. When the
stories told by the two parties diverge so drastically the jurors will be glad
for every little piece they can just rely on without having to expect a
