Oracle's lawyer is still committing perjury in court. That is a severe problem,
and the judge shouldn't let it go on with the jury getting false information.
However, as has been brought up before, there are questions of law and questions
of fact. If Oracle wants to lie to the jury about questions of law, but the
judge (who is not fooled) will be actually making those decisions, then I guess
that's OK. The courtroom proceedings can establish the fact of what copyright
license (GPL) Sun used to publish the specifications. And then it can establish
the fact that Google's implementation was independent and does not use Sun's
code. Then, the judge can just issue the ruling that Google's actions, as
established by those facts, do not constitute copyright infringement--done.
So I guess those are the methods to handle it, but it shows why I could not be a
litigation lawyer, because I couldn't just stand there and tolerate seeing the
opposing lawyers constantly lie to the court.[ Reply to This | Parent | # ]
