While I do not question the competency of Google attorneys, I
sometimes wonder whether they will spot things like these,
after all, they are just human. I can only hope and pray that

I smell M$ in this somewhere. Problem is, where? Oracle is
one of their best-poised competitors. Some left-field
guesses:
-- M$ quietly offered to take SQL Server out of certain
markets in exchange for Oracle winning this
-- M$ offered priority access to certain APIs in exchange
-- M$ offered to sell Dynamics to Oracle at a discount
Now that Oracle appears to be slowly losing, I think they
might play to lose at some point. Why? If APIs lose any
kind of intellectual rights protection, Oracle could
conceivably gain all kinds of access to M$ APIs. M$ vendors
and competitors previously held at arms' length by APIs
would be able to run amok on M$, finding ways to chip away
at their businesses as well as mete out payback in court.
Oracle would come away a winner in the long haul.[ Reply to This | Parent | # ]
