They plan to put the SUN president on in the Google case-in-chief to bookend
this trial with Presidents saying anyone can use JAVA. Ellison looks like an
evasive liar and the judge helped. It may settle to save a few weeks of fees.
Complexity and confusion would not overcome this gut impression.

Ouch! That's gonna leave a mark. Isn't that called ' impeaching a witness'? It would seem that differences in video from a deposition and statements on the stand might infer a little more than 'apparent contradictions' from a seemingly friendly press.

Once as the say is misfortune. Twice is a tragedy. The question then becomes whether or not tomorrow will supply a thrice 'apparent contradiction' and transform Mr. Ellison's efforts into confident carelessness.

You could also wonder how Mr. Ellison reacts to being coached tonight by less than confident counsel.

I'm guessing that won't look good to the jury, being unsure
about a fundamental aspect of your case, and then being
shown video evidence of yourself admitting a large part of
your opponents defence.

Maybe he was trying to avoid having to get into the details
of what java means in which circumstances, as it's fairly
fundamental to his case that the terms be used
interchangeably to conceal what is being discussed.

I'm hoping this will come across to the jury as sleazily as
it actually is, and we'll see more cross examination showing
that this is a pattern.

This switcheroo behaviour should be allowed up to the point
that they destroy the credibility of their case.
