I am surprised to some extent that EFF hasn't filed an Amicus brief in this case
as if Oracle gets its wish then that would cause great confusion in ALL
programming languages.

When do friend of the court briefs get submitted

You don't have amicus briefs at trial. They are only submitted during the
appeals process if one party asserts there has been a mistake at trial in
applying the law. What can be done at trial is to put experts, such as Pam
Samuelson, on the stand to testify. Not sure if that will happen or needs to
happen since those interpretations will be made by the Court (i.e., questions of
law), and Prof. Samuelson's work has already been acknowledged by the Court.
