You may be on to something here. Quite a bit of what Boise has tried recently in the Oracle and SCO cases looks like an inexplicable wish to set up unwinnable situations.

What if he was completely blindsided by Jackson. He thought he had the case in the bag; 100% proof that Microsft broke the law. A judgement of facts which could never be, and never was reversed; no way out. Then Microsoft proved that, for people with the right friends, the US justice system always has a way out.

Now he's fascinated with this. He's trying to learn how to win unwinnable cases. He wants to learn to be like Miyamoto Musashi, able to fight with a wooden sword against a fully armed opponent.
