Novell has followed through, as it said it would, and has filed a notice of appeal in its litigation against Microsoft over antitrust issues from WordPerfect. Here's the docket entry:
08/10/2012 - 512 -
NOTICE OF APPEAL as to 511 Judgment, 510 Order on Motion for Judgment
as a Matter of Law, 509 Order on Motion for Judgment as a Matter of
Law, Memorandum Decision filed by Novell. Appeals to the USCA for the
10th Circuit. Filing fee $ 455, receipt number 1088-1652353. (English,
Maralyn) (Entered: 08/10/2012)
08/10/2012 - 513 - Transmission of Preliminary Record to USCA re 512
Notice of Appeal. (jmr) (Entered: 08/10/2012)
Novell appeals against the judge's handing a "win" to Microsoft without trial, after the first jury deadlocked. So let's keep working on those Comes v. Microsoft exhibits, turning them into text. If there is a new trial ordered, you just never know what might come in handy.
It ain't over 'til it's over.
