Latest News on the Bankruptcy - More Matters for 6/17 Hearing |

Some filings in SCO's bankruptcy, including SCO's latest operating reports and a notice to add to the June 17 hearing consideration of the "Quarterly Fee Applications (related document(s)[462], [474], [479], [460], [478])".
Those numbers refer to bills covering January through the end of March from Berger Singerman, Mesirow, Dorsey & Whitney, Tanner (already scheduled for that hearing date), and Pachulski Stang (already scheduled for that hearing date), all PDFs.
That could be a long hearing, because it will also cover SCO's second motion to extend the exclusivity period, again, the motion to expand Tanner's services, and some other bills. And then, ah yes, the matter about whether SCO's claim that it has an ethical need to pay an "expense reimbursement" to York Capital, which has been strenuously objected to by IBM, Novell and the US Trustee's Office.

If Kimball would only issue his ruling so we can move forward.
Everyone seems to be sitting around waiting for him, except for SCO who seems to
be spending as much money as possible.

The only thing anyone at SCO knows about ethics is that they don't have any! I
tried SCO's line at the mall today. I approached the manager and said, "I
decided not to buy anything in your store but I would still like the money you
ethically owe me just for browsing in your store."
He wasn't convinced of his indebtedness.

It is quite possible that,
absent a reorganization plan from elsewhere, motion to extend the exclusivity
period will be continued to the next hearing.
It is almost certain that
the motion to expand Tanner's services, and some other bills will be
dealt with by lack of objectection.
It is quite possible that ethical
need to pay an "expense reimbursement" to York Capital will once more be
continued to the next hearing.

I think we are near the end of this chapter of the story. I don't think that the
chapter will have a surprise ending, but I'm waiting with anticipation for it to
be written.

The last filing - the '483.pdf - includes a financial summary for the Group. On
page 6 of the pdf we see that SCO are claiming :
$1,314,859 - Total Assets
$1,745,258 - Total Liabilities
and a net owner equity of -$430,399...
So I guess this clarifies that since SCO filed for Chapter 11, when they had
more assets than liabilities, they have managed to reverse that position and now
really are bankrupt.
One has to wonder if Judge Gross is going to move this case to Chapter 11 before
or after Judge Kimball hands down his final judgment on the Novell case.
