Jean Acheson Listed as Head of SCO Germany - Update: She's SCO Group's Ethics Officer too

I know. It's simply unbelievable. The new head of SCO Germany, according to its website is none other than Jean Acheson:

Geschäftsführer Deutschland: Jean Acheson
Handelsregister: HRB 4841
Ust-IdNr.: DE 114 220272

That's nice and cozy. Keeps all the details inside the inner circle. Of course, she's new on this job, too, so she is still learning and doesn't actually *know* anything yet. Like about money flowing back and forth. Stuff like that. She'll get back to us, though, I'm sure. She probably has no German assets, so it's also handy now that the German subsidiary, which isn't in bankruptcy, is being sued.

The more she sings, a cynic might say, the higher she goes. At this rate, she and Sandy Gupta will have to fight over who rules the world. Well. After Darl and Ralph, of course. Watch your backs, newbies.

The page also lists Bert Young still as CFO, and this change -- assuming it isn't some German SCO employee having a ball putting up silly or legally forbidden pages -- has yet to be recorded in the German register of the company CEOs, the "Handelsregister" but I understand that takes a while.

So, the SCOmazings are at it again. And if this is not better than a Hollywood movie, I'm a monkey's uncle.

Update: In this episode of "All Our Litigations", we find that Jean is also the SCO Group's Company Ethics Officer. So if anyone were to notice any violations of the SCO Group's ethics policy -- not that *that* would ever happen -- she's the person you'd tell and file your information with. I'm sure that works very well indeed, in fact precisely as intended.

Well, there may be a simple explanation. Possibly, no German citizen is prepared
to be appointed to take responsibility for what SCO US wants them to do... There
is more responsibility for one's actions, in Europe..

New PR from empty shell Me Inc.

At the 341 hearing Darl said Me Inc was an empty shell with no assets or
liabilities.

Somehow this company did work on a product release and put out a press release
yesterday. Beyond the fact of it being interesting how and why an empty shell
would put out a press release, it would be interesting to know if the Cattleback
patent sale would affect the ability of Me Inc to operate.

Looking up the address with Google...

It seems there are at least six other companies listed at that address. On Google Maps the building doesn't look huge.

So I'm guessing that SCO Germany isn't a huge outfit.

Interestingly, this page, updated October 12th, lists only two people;
Hans Bayer as manager (Geschäftsführer) and Werner Metz as sales manager (Vertriebsleiter).

And while the title might imply that there are more people doing sales, it is a pretty common trick to call a single salesperson a sales manager to make the position look more important.

Most companies have 'careers' as one of the standard items on the homepage menu.
Oddly enough, SCO germany isn't one of them. And neither is sco.com.

I wonder why? ;-)

They just can't seem to find a judge they can buy. So here is another loss in the win-loss colume. This this makes their record, what, 0 for (too many loses to recall). Here is a report from Linux-Watch. SCO loses again

Another thing she doesn't know

... is that in Germany, being CEO (Geschaeftsfuehrer) can land you in jail very
quickly if the company is engaged in illegal activities, particularly bankruptcy
fraud. You can also be held personally liable quite easily.

It should also be noted that the state attorney's office is notified of and
investigates every bankruptcy filing.

On the plus side, jails in Germany are supposedly a lot nicer than federal
penitentiaries in the US.

1.) The SCO Group GmbH, Frankfurt am Main
2.) The Santa Cruz Operation (Deutschland) GmbH, Bad Homburg
3.) Caldera GmbH, Bad Homburg

Ahh, the good old times... But now I'm a little puzzled whether they are
currently in Frankfurt or Bad Homburg. Well, no big difference.

Hollywood is too fast paced for the SCOGs

think "soap opera"

where it can take a pregnant woman 5 episodes to deliver a baby

where plot unfolds over 2, 3 or 5 year spans, and the plots become incredibly
convoluted, mixed-up and incestuous (this recent SCOG/Baystar/Emerson/MS/York
stuff is classic soap opera stuff)- incestuous, and to outsiders, completely
ridiculous.

Interesting because:

She cannot be served a writ because she will not be in Germany

They cannot be sued in the US of A because of the stay

They have no money to fight the case or pay fines without Judge Gross' permission.

More delay in Delaware where Judge Gross will be asked to declare their cases stayed. (the ongoing case is about SCO Germany trying to shut someone up).

FUD and propaganda for free

More delay whilst the get the cash into the subsidiaries, never to be seen again
