Here is some fresh Pacer harvest: Novell files something under seal and gets another lawyer; IBM gets an extension of time and Jeffrey Leitzinger gets a protective order (pdf) for his Personal Financial Information...

Groklaw has previously reported on the motion and IBM's answer.

Please everybody download as much as you can
of iowaconsumercase.org before it goes offline.

In the DR-DOS ligation (if I remember well)
the materials went offline a week after
it was settled, by judge order.

Replicating these materials for redundancy
is important to preserve them for posterity.

Analysing every single detail in them will
have us busy for years to come, I anticipate
these materials will be very useful in future
Microsoft attacks.

Is PJ really sick, or just hiding from the legal action?

and one wonders if there really is a PJ anyhow (despite all the claims)

the nature of bogus litigation we know so well from this site.

SCO thinks PJ is an IBM front for the same reason they think IBM is why Linux is successful

This is funny. What's SCO's evidence that PJ is a front for IBM lawyers rather than who she (or he) says she is???

...the quality of the work. They disbelieve that it's possible for Groklaw to be so good unless it has funding, corporate support, etc, therefore it must be a front for IBM.

What is SCO's evidence that Linux used code stolen from them? Well, none of course, but ironically, again, they disbelieve that it's possible for Linux to be so good unless it had funding, corporate support, etc, and, therefore, IBM must have been responsible for making Linux good enough to compete against UNIX.

Fundamentally they disbelieve that anything of high quality can be produced unless it's done by a business out to make a profit, even though they ship PostgreSQL, gcc, and, in fact, open source software is the backbone of their product, particularly since Oracle and others, seeing their miniscule and declining market share, ceased to support their products.

On a side note, Buchanan avoided jail for Watergate because he was "just a speechwriter". Hi, Blake.

Copiepresse wins Belgian court battle against Google, fines reduced

Copiepresse has published the PDF of yesterday's ruling of the Brussels Court of
First Instance which upholds the previous judgement against Google, while
reducing the daily fines to 25,000 EUR.

Margaret Boribon, General Secretary of Copiepresse, stated in our Groklaw
interview that she wanted to negotiate with Google, but they refused to
communicate...

The Movie Spartacus

officer faces the crowd of sitting slaves and asks, "Who is
Spartacus?"

Its not up to SCO. Its up to the Judge.

Anyone can fight a subpoena and let the judge decide if the burden inflicted
outweighs the relevance of the information sought.

Anyone can walk out of a deposition if one side is actually being too abusive
and then let the judge decide if the discovery line should continue.

What really bothers me is that if the subpoena nonsense is true PJ must be in
quite a jam. She made it very clear that she doesn't want her private life or
her identity known, and she has all rights to want it thus. But with the respect
she has for the justice system this might be a very nasty dilemma.
I hope it is not the reason for her health break but I surmise otherwise.
I wish her lots of wisdom and hope this idiocy goes away before she has to
choose between a rock and a hard place.
It's a scummy thing to do do a person, but that SCO was scum is no surprise.

The question in my mind is this; where has this idea that SCO tried to serve a
supoena on PJ come from?

a) Is it in a court filing?
b) Has it come from the court appointed bailiff (or whoever tried to serve the
supoena on PJ)?
c) Or has it just come from SCO via the press?

I actually don't know, but I suspect c) is about as close to the truth as we are
going to get when dealing with SCO.

Excuse my foriegn language. Does anyone know where there is a mirror of the
transcripts for the Iowa Comes VS Microsoft files? For some stupid reason, I
thought that the public transcripts would remain public. Now you can't get in
unless you are "AUTHORIZED".

I know, Mathfox, you're over worked, and it is well
appreciated! Thank you! As a suggestion, new major topic
would be appreciated also. It gets tough to separate the
new from the old after 500 or so postings.

Regardless, send a "Thank you, we love and miss you." to PJ.
We all (I assume that is a fact) miss her. Oh, we like
you too. :) Hey, hey, you know what I'm saying.
