SCO's Next Financial Results and Conference Call April 13

Let's synchronize our watches. Wednesday, April 13 at 5 PM EDT SCO will tell us how they're doing financially. They'll announce their first quarter results, for the fiscal quarter ending 1/31/05 and hold a conference call. Here's their press release.

Perhaps they'll have all their paperwork filed with the SEC by then, because they still have not filed that 10Q, according the www.sec.gov, at least not that I could find, and one wonders how long you get to wait before you file a late 10Q after a delisting notice. Such questions are what a conference call should be able to answer. That's if SCO deigns to call on anybody likely to ask a real question this time.

As we told you already, they filed their tardy 10K and the 10Q for the period ended January 31, 2004 on April 1. They also filed a 10Q for the period ended July 31, 2004 and a 10Q for the period ending April 30, 2004.

Note how the press release self description (over time) is paralleling their
falling hopes. Hard to do, but I'm trying to feel a little pity for Darl McBride
tonight. What a reflection on our cratering society?

Spin The Disc!

Hey, everybody!

Oh, I don't want to miss this. Although it does conflict with my work
schedule.

I recall that there is software that will enable my computer to record streaming
audio. Does anyone have any recommendations? Linux or Windoze, either or.

Always thinking about the efects

Good thing they're making sure to wait until after markets close to announce
their results. We want to give the nation time to analyze it overnight before
some dire effect on the economy. After all, today almost 4,000 shares traded at
somewhere near $3.50. That's almost the same effect as someone buying a
subcompact car somewhere.

Bait and Switch Question?

Excuse my ignorance of these conference calls, but what's to stop someone
submitting a patsy question (the slow pitch type that the execs look forward to
socking out of the park) and then if called on to ask it, substituting a more
interesting one? I guess if it was a regular analyst, then he/she would be
passed over at other C.C.s.

[This technique made the mock Interviewer Dennis Pennis some amusing T.V. in the
U.K., but led to other interviewers elbowing him back at red carpet events as
Celebrities began to shun press calls in case he was there]

In the recent (late) 10-K document The SCO Group Inc. states this on page 14:
We are a party to certain other legal proceedings arising in the ordinary course of business including legal proceedings arising from our SCOsource initiatives. We believe, after consultation with legal counsel, that the ultimate outcome of such legal proceedings will not have a material adverse effect on our results of operations or financial position.
Those who participate in the conference should ask for further details. They might get a reply which they do not expect.

Massive redundency?

SCO have lost 5,000 resellers and developers since their last press release,
down from 15,000 to 10,000. That's a third of their reseller/developer
relationships. Of course it could mean that, on average, UNIX resellers have had
to lay off 1/3 of their staff, but that's a bit unlikely.

Conference call questions

A few suggestions for questions if any of us gets through. Make sure they answer the questions truthfully and thoroughly.
  1. How close is SCO to bankruptcy?
  2. Can SCO prove that there is unauthorized derivative code in Linux? Prove it (if given answer is yes). (Mention Judge Kimball's CC10 PSJ quote, the two paragraphs under the heading "Discussion", the "Netherless, despite the vast disparity..." one.) What happened to the "millions of lines of code"?
  3. How are you going to win your court cases? What is your plan for the future? (Step by step would be appreciated. The more detail, the funnier it gets.)
  4. How are you going to pay for the code analysis - the stuff you are going to get pursuant to Judge Wells' Jan 18 order? (The fee cap does not cover for outside expert analysis.)
  5. Why have there been upticks in your stock price just before bad news is announced? (Mention manipulation as a possibility.)
  6. Where's the 10-Q? In Blepp's briefcase?
  7. (if the NASD delists by 13 April) What do you have to say about the delisting?

I bet there is more, but they'll probably time us out after the we ask the first two. Does anyone have any better suggestions?

Unix; indeed, it does not reference Unix in any manner.

SCO junk mail, and OS6 feature set

Rather unfortunately I get junk mail from SCO. This latest mailing I found interesting, however, because they refer to several "new" enterprise class features in OpenServer6, which I gather did not exist before, and which generally have existed in GNU/Linux systems for awhile. No I am not suggesting they are copying, though I do not dismiss the possibility, but rather am pointing out that rather than SCO's Unix having some magical enterprise features which GNU/Linux lacked, it is often the other way around. The features that caught my eye in this respect are ADDITION of "large file support" and "multi-threading".

Execuse me, it's 2005. These are only now being added and hence presumably non-existent in their previous product offerings? Then how could GNU/Linux have some aquired them from SCO in 2000?

But perhaps there are other golden nuggets in this, so I will be happy to share it if PJ thinks I can, or at least in a radicated form, as it seems they wanted to tell me all kinds of pricing information, contact phone numbers, and other things I really did not wish to know either. It's bad enough when I get unsolicited and unwanted email from Microsoft, but for SCO to do this, well let me retch. I dont know how I ever got opted in, but they had an opt out thing before, too, and simply ignored it before.

Here is the relevent excerpt:

Momentum is beginning to build with the anticipated release of SCO OpenServer Release 6. The beta period continues and reports coming back give excellent reviews to the new capabilities of this major release including the phenomenal speed of existing applications, the multi-threading and large file support enabling it to support modern applications and many other features. The first customer ship date is anticipated to be in the latter half of Q2.

That was the part that made me think, wow, how do they claim features in GNU/Linux were copied from features they themselves didn't have until recently, or lacked enterprise features they did not have but GNU/Linux has had for awhile, but that is an old story...

Appearently they are having some sort of release party in NYC for their OS6 launch, and are "threatening" to have yet another SCOForum this summer in Vegas; makes perfect sence for the gamblers they are...

There are some other companies that would or should probably be embarresed to be associated with them shilling some products I am also uninterested in. Nothing else really looked as amusing...
