Two Hearings Set in SCO v. IBM -- on Palmisano Depo, 3rd Complaint, G2 |

There are two hearings set in SCO v. IBM in April. Actually, there are three motions being heard, four if you count G2's motion to intervene and to unseal as two motions, which they are, but they are set on two days. First, on April 21, at 3:00 PM, there will be a hearing on SCO's Motion to Compel the deposition of Sam Palmisano and on their motion to amend the complaint a third time. Then on April 26, also at 3:00 PM, there will be the hearing on G2 et al's motions to intervene and unseal. So, mark your calendars. Setting the hearings for 3 PM tells me they don't expect the hearings to last all day or any significant length of time. Here are the Pacer entries:

[Entry date 03/17/05] So Judge Kimball will be deciding these motions. If any are planning to attend, be sure to check with the court to make sure the public will be allowed in. The motion to file a 3rd Amended Complaint is sealed, and since it has to do with the POWER issue and maybe some privileged emails, I gather from all the hints SCO has been providing, it is conceivable (although unlikely) that the hearings will not be open. There have been sealed documents related to the Palmisano motion too, so just be sure to check before you do any serious traveling or make arrangements to take off from work.

For instance there is a missing word in the last line - I believe it should
say "take time off from work. --- All that matters is whether
they can show ownership, they haven't and they can't, or whether they can show

Implicit in the motion to file a third ammended complaint is, I think, the issue
of privlige of the famous IBM emails.
I wonder if those portions of the hearing will be closed?
