SCO Conference Call on 4thQ & Year-End Financials Dec. 21 at 5PM EST

SCO announced today it will release its 4th quarter and year-end financial results in a conference call after the market closes on Tuesday, December 21. The call begins at 5 PM Eastern Time.

They chose a 5 PM time for the last conference call, too. Before that, it was typically at 11 AM. Maybe they'll explain how their stock goes up on no good news at all. They offer the media the opportunity to participate in the live call or alternatively they can access listen-only mode. I might call in.

Joke. Joke.

I notice Yahoo still has the November 18 story about Ballmer warning Asian governments about Linux suits highlighted on their SCO page. But I also noticed that the stock started going up earlier in November. I admit I find it fascinating. Anything that contradicts what logic would dictate is interesting, because you can't help but wonder, what is the missing piece? Hopefully, someone will ask them during the conference call.

Here's what Dion Cornett's most recent Open Source Wall Street says about the stock:

"Due to recent strength, SCOX continues to trade above our $3 price target

"For the 2nd week in a row, SCO Group (SCOX: Market perform) was the best-performing stock in our group, returning 23%, ahead of the Company reporting FY04 (Oct) results this month. Despite the run-up, we believe that the potential for upside surprises during the quarter is limited given the Company’s relatively stable core business and our continuing skepticism with respect to its SCOSource licensing program. Specifically, we expect Q4 revenue of $10.8M, down sequentially from $11.2M, and a loss of $0.18, better than the $0.36 loss reported last quarter, although earnings will likely be highly dependent upon the accounting treatment of legal expenses during the quarter. While we maintain our Market perform weighting given SCOX’s volatility and limited trading volume, we note that the stock, now at $4.75, trades well above our $3 price target, and suggest selling into any strength potentially attributable to fresh speculation and year-end positioning. Again, a meaningful legal victory for SCOX is at least a year away, in our opinion, while upcoming hearings such as IBM’s (IBM: not rated) request for Partial Summary Judgment, originally scheduled for this week, but now expected mid-to-late January, could gut its case in the interim."

As usual, please know that I have no idea what the stock market is about, although I have certainly been watching these past couple of weeks, so don't do anything on my account. As for a time frame for a "meaningful legal victory for SCOX", personally, I'm guessing that'll be more along the lines of when pigs fly.

Isn't SCO buying back their own stock these days with free
cash? If my memory is accurate then maybe this is why the
stock price is up.

The news isn't going to be good, or they would schedule the conference during a full trading day, away from any holidays.

Late on the 21st is a good time for reduced press coverage, and less people reading what does get written. I suspect the ideal time to announce bad results would be Christmas Eve, after the market closes. But if they were to announce now, that they were scheduling the conference call for the 24th, it would be blatantly obvious that they're trying to hide something.

I believe they are required to publicly announce the end of quarter and year results by some deadline. What is that deadline? If they have the opportunity, I suspect they will generate an excuse to postpone releasing the figures until closer to Christmas. If they do that, they probably won't announce the postponement until the 20th.

Scam Stock

Anybody who has been watching this stock knows that it's been manipulated
mercilessly. Some people were speculating that the stock was being
"painted" to devalue the stock options that were handed out today,
others seem to think there is some end of the year manipulation going on.

Either way the stock is a scam. It's being manipulated by a few entitites to
suit their own agenda. The SEC as usual is asleep at the wheel and is not likely
to do anything about it.

PJ, considering what breaches of your privacy and safety have been attempted or
threatened by the SCOundrels and their fellow travelers, I know that you're
really not talking about joking matters.

Maybe you don't need to call from a payphone two states over, but I would
encourage you to call in from some place or in some way where nobody with
malicious motives would be able to "pick up the scent", as it were.

I think calling in would be great--I'd love to be a fly on the wall if your call
got picked at random to ask a question, they ask you to identify yourself and
your publication, and you answer loud and clear, "Pamela Jones,
Groklaw". I have this vision of DMcB turning green and the impression of
involuntary excretory functions occuring amongst several of the SCOundrels.
(Hope that's a "clean" enough description for you.)

Just be safe in how you do it. We don't call 'em the SCOundrels for nothin'. And
we care about you and your safety. Heck, *I* care about you and your safety!

Any bets on what the wookie will be this time around?

Of course they need a wookie to distract attention from falling sales, losses
and a prospective CC10 ruling. Otherwse their stock might tank to $3.00 or lower
despite recent paint. Judge Kimball might even rule during the conference!

Last time around it was the shareholder plan and capping the legal fees. Q2 was
the shorting in Germany (if I recall correctly). So what's the wookie this time
around? Any bets?

With respect to stocks like SCO, the stock market is a way to gamble without
flying to Vegas. Every day is a crap shoot.

Your losses get better tax treatment than losses at the table.

SCOX stock price

This has facinated me from the start... well the whole story of the SCO has as
the Grok watches all know. But the share price. What wins are SCOX having that
sends the share from $3 to $5.... and for that matter what press realeases
either.

My personally best guess would be some sort of market manipulation from those
with billions they can't already spend who have millions they'd lose gladly to
make more billions they will still never spend.

Ah it all too entertaining for it to end so soon anyways and Linux, GPL, Linus
and the lovable penguin are near household terms anyways ...... thanks Darl:

Who benefits most NOW from the bump in stock price?

Baystar.

They started selling in September. They ramped it up in October and by early
November the stock started lifting significantly. Now, in December, with the
spike in price, they can't offload quick enough.

If nothing else, Goldfarb et al. know how to 'massage' a stock price.

SCOX was depressed due to Baystar selling

I am completely ignorant about the stock market.

However my explanation of the recent rise is that Baystar's long term selling of
stock had 'artificially' lowered the price.

Now that they have finished selling (??? Only my assumption), the price has
rebounded to its 'normal' level.

This is basically just the effect of supply and demand.

The only pig that's going to fly is SCOG, and I know it because the Open Source
community is supplying the catapult. Make sure to wave at the screaming piggy
flying overhead before it crashes into Ralph Yarro's Canopy. Thereafter, SCO
piggy will be known as SCOG porky. Speaking generally: planes fly, but can
rockets, stones, rotten eggs and catapulted pigs be considered as
"flying"?

I for one look forward to hearing about their new product lineup of lawsuits for the new year. I know some of their current products (sue IBM release 1.0, 2,0, and 3.0; as well as their ever popular "sue your customer" series of products) were initially received in the marketplace with very dissapointing results. But I am sure they will be talking about the hard work they have been doing in product R&D on new forms of litigation. Perhaps this is the year they will come out with a "killer" product?

I am sure that "Sue, Collect, and Obsfucate" will have a very bright future years ahead as a manufacturer of litigation in the very broad marketplace known as the American court system.

Without highlighting the parent company financials, Canpoy, its a fool's errand
to analyze CSOX's statemnts..

Especially if we are to see if Canopy did back table deals to make profits on
the rmap up of SCOX's stock..

PJ - Are you trying to break their system of abuse and mafia-style busniess
practices? That is what companies like that hate you for..your curiosity?...The
pursuit of the Truth and exposing their evil practices (holding computer
technology for ransom - which the call "profit", and mowing down
anyone who stands in their way - which they call "necessary litigation and
defending I.P.")

This is how Microsoft won the battle in the nineties. We trusted them and we
found out they were screwing us all the while (they were judged an illegal
monopoly.) They will be overthrown. How is that statement relevant to SCO
litigation? SCO is a knight on Microsoft's chess board. Microsoft's pauns are
not helping the game anymore.

Linux and Open Source ARE changing the face of the computer market. And
truth-seeking efforts like Groklaw don't help the efforts of the people on the
deceptive side of things.
And what we would interpret as deceptive is what Microsoft calls
"marketing."

Appended below is a recapitulation of Baystar sales with price and volume
data in csv format for easy import into a spreadsheet.
Fields: Share are Baystar daily sales reported on form 4 filings with SEC
Price is weighted average price of the baystar sales (reported individually on
the SEC Form 4's)
Limit is percent of permitted sale 10% of the trailing 5-day average volume
vol is total share volume.
avgPrice is mean of Open.High.Low.Close meant to buffer end of day paint.


Observations: Baystar lapsed in the 10/15 to 10/26 period. This also marked
rapid share price erosion. Buy Institutions were sitting on their hands in the
period, though sale volume was strongly up.
November sales commenced before the market price turned up. Market price
falls in the absence of Baystar sales, rather than its presence.
Only 4 days were skipped in November. Sales come in blocks, final 2 days
sales are often below limit, indicating a pre-arranged sale is being
completed, rather than open market exchange.
Shares sold don't appear to languish on the OTCBB board indicating the buyer
is precommitted.
No one has identified the MM used. Future sales will be opaque for this
reason as Baystar is now below the

I'm sure that was Dion's nice way of saying something that he couldn't, in his capacity, legally say.

One day, when the smoke clears and the guilty have been judged, a book is going to be written that will be considered required geek reading material, just like Free Culture and Cryptonomicon. I know it will sit proudly on my bookshelf.
