I found the list really interesting. Not so much the
initial 57 items, most (if not all) of which we've
already seen, by the sealed items as well as the 11
"Authorities."

I can guess at several of the sealed items, but the
Authorities are fascinating in the wildness of the
groping. Some of these have been elucidated here by
our legal eagles; some have been on Lamlaw. None, as
far as I can tell, is truly apposite.

Like so much else this past two weeks, this is meant
to cast doubt so that a jury trial will be necessary
in 2043 or 2044.

so when miss "what's her name" says that she wants the documents
unsealed. is she saying only IBMs sealed Docs or all of them?

if SCOG is so in favor of having everything in the open, then why not a show of
good faith?

show us everything, including the code they are relicencing that does not
conflict with the GPL.

What I find interesting is the paper trail for the rights to UNIX
(notwithstanding the 'issues' regarding what the various agreements actually
conferred, what they _could_ confer, etc, but that's another matter):

We have AT&T/USL -> Novell
We have Novell -> Caldera

We don't have Caldera -> SCOX

Now, I'd assumed they had filed this as a sealed exhibit, but it seems that
they haven't bothered to pull it out. Or they don't have it.

So.

Do SCOX have any proof that they have _any_ rights to UNIX, no matter how
tenuous? Are they qualified to bring _any_ of these lawsuits? Without that
one, rather important, piece of paper, It seems to me that the answer to both
of these questions is a resounding 'no'. But, as usual, IANAL...

Exhibit 57 identifies a document dated 10/16/96 as
"Amendment X to Software and Sublicensing Agreements
between AT&T Technologies, Inc. and IBM Corp."

This should read "Amendment X to Software and Sublicensing
Agreements between Santa Cruz Operations Inc., Novell,
INC., and IBM Corp."

Not too bright!
