IBM's Motion to Strike the Declaration of Christopher Sontag will be heard on September 14, 2004 at 10 AM before Judge Wells. The previously scheduled hearing on SCO's Motion to Compel, set for September 2, will now be heard the same day as IBM's Motion to Strike, on the 14th. That is the day before the hearing set for SCO's Amended Motion to Dismiss or Stay Count Ten of IBM's 2nd Amended Counterclaims and IBM's Cross Motion for Partial Summary Judgment for Declaratory Judgment of Non-Infringement. This will be before Judge Kimball. So September will be hopping.
There has also been an Order granting the parties' stipulation to amend the dates briefs are due on pending motions.
Here is the Pacer notation and I'll have the order ready shortly:
8/12/04 222 Stipulation by Intl Bus Mach Inc to amend briefing for pending motions (blk) [Entry date 08/13/04]
8/13/04 224 Order granting [222-1] stipulation motion to amend briefing for pending motions signed by Judge Dale A. Kimball , 8/13/04 cc:atty (blk) [Entry date 08/13/04]

To prop up it's share price so Darl and co. can dump some more before this next
blow lands them in the penny stocks?

Maybe I've lost track here, but it seems to me that the hearing over striking
Sontag's declaration will be held 12 days after the hearing on the discovery
motion which it apparently supports.
Or is it only in support of the long and wingeing memorandum regarding discovery
(filed before the motion to compel)? In which case it all seems a bit
pointless.

This is one of the three stories that disappeared earlier this morning. That is
why the time of the comments doesn't match the posting time. By the way, I
am getting reports of troubles with accounts and comments too. We are
having a PHP moment, folks, and I'm told it may be because Groklaw may
have outgrown Geeklog. That is what it is beginning to look like.[ Reply to This | # ]
