Robert Bench Replaced as CFO, To Retire in 6 Months |

SCO has announced that Robert Bench is retiring and they will have a new CFO.
It seems Mr. Bench wishes to retire, though he'll stay on for six months more in an acting VP capacity, where he will focus on "external growth opportunities and industry partnerships", which I think means they urgently need to find some money this exact minute. His replacement as CFO, Bert Young, comes from a background that includes a term at a company called Waste Management, Inc. I'm sure he is highly qualified for the task ahead.
Here are two press releases about it. Note the last paragraph of the second: "Linux is open source software, meaning that software developers can freely modify its code, and is based on the Unix operating system, which had been used in many large corporate data centers. SCO owns the rights to Unix and collects licensing fees for it. It also has collected licenses from some companies that use Linux." Pitiful, huh? I got a second-hand report from the shareholder meeting, by the way, that there were no fireworks, only about 20 shareholders showed up, not including the BayStar folks, and the rah-rah word to the troops was that they would win the lawsuit. Of course, they kind of need to say things like that, no matter what they think when they lie awake at night, staring at the ceiling. There is already one law firm notifying SCO shareholders on Yahoo's Finance message board that it specializes in shareholder class action lawsuits.
By the way, Forbes is running a poll on Linux. I suggest not taking it, because I personally don't trust Forbes to play fair. I see no reason to mislead their advertisers into thinking the community finds Forbes of interest, either. They have seriously shown a bias against Linux for a long time, and I don't believe the survey can possibly be scientific, which wouldn't stop some from using it to defend SCO if Linux were to "win" the poll (SCO asserting that SCO hasn't caused any financial damages and thus needn't pay for any such losses, for example), and it's too easy to stuff the ballot. All anyone would have to do is erase all cookies from prospero.com, atdmt.com and forbes.com, or use a few different computers, and vote again and again. (Hmmm.... and then later fess up, thus invalidating the results.) Consequently, this poll's "findings" will be absolutely meaningless, except maybe for some FUD. I say this despite the fact that at the moment, Linux is "winning." It also crosses my mind that Forbes could keep logs on who took the poll, maybe even noting how they vote? I haven't read their privacy terms, but I'm thinking there are just a lot of reasons to stay away from Forbes.

NEW YORK, April 21 (Reuters) - The SCO Group Inc. (NasdaqSC:SCOX - News), the software company suing IBM over the Linux operating system, said on Wednesday that Chief Financial Officer Bob Bench plans to retire later this year, and named Bert Young to replace him.
Lindon, Utah-based SCO, which owns the Unix operating system and says that the operating system Linux violates its copyrights, said that Bench will become acting vice president of corporate development and retire after the position is filled permanently.
Bench has been the company's CFO for the past three and a half years.
SCO, which began its fight over Linux with International Business Machines Corp. (NYSE:IBM - News), which sells computer hardware that has Linux software on it, has since said that it would expand that fight to include other companies such as AutoZone Inc. and DaimlerChrysler AG.

I know nothing about this company in particular, but the waste management
industry in general is heavily infiltrated by organized crime. Maybe someone

If I were him, I would probably want to retire NOW, so that I can exercise and
sell 100% of my options NOW and not wait until they are worthless.
In fact, retiring some time last year would have been much more profitable.

Young was CFO at Landesk (an Intel spinoff???), CIO and VP of administration at
Whittman-Hart ("an IT management company in Chicago"), and CIO at
waste management.
There are a few snippets on the web touting him as an example of a "new

What effect will it have on SCO if the stock price falls too much? I get the
impression that some people link this with SCO going bankrupt - why should this

I think this is a very clear admission that they have no claims over Linux per
se, as they are saying in a press release that software developers can freely
modify its code. I notice they carefully steer clear of mentioning the GPL,
copyrights or any contractual issues with IBM.
How will this statement affect any of their legal cases, or are they merely
stating what has already become established fact?

Perfect.
Waste Management Inc was one the big financial scandals of the '90s, before the
days of Enron, etc.

It appears that Bench was an executive at that time, and has been bouncing
around ever since.
Presumably, he was not named in the investigation because he was CIO and this
was apparently a financial problem and not an opertaional problem, however I

I know
that this has been discussed ad nauseum, but it really makes me grit my teeth
every time I read this phrase. First of all, their "ownership" is contested,
and secondly, they certainly do not own the trademark registration for the word
Unix. Basically, it's like the first phrase out of their mouths in every press
release is a possible lie and a certain distortion, and all in one sentence
fragment!
Obviously, their ownership is being contested, but when the
mainstream press picks up on it and repeats it, the idea that SCO is the owner
of unix, it's trademarks and everything else gives the general impression that
indeed, these long-haired Birkenstock hippies have stolen from them and given it
away on the internet.
In life, the impression you give of the truth is 95% of
what people who don't know better will believe. SCO does this willingly, and
IMHO is a slander of Novell. We'll see after the litigation process, but in the
meantime, methinks that this might be part of the reason their boilerplate
"forward looking statements" is part of the footer. (Yes, I know every company

Many IT managers would rather crawl naked over a nest of
fire ants than buy an SCO product. Even managers without any particular opinion
on whether SCO is right or wrong would wonder how long SCO is going to stay in
business, and thus hesitate to buy their products.
It seems to me, then,
that their traditional business is dead in the water. The obvious thing to do is
go into "harvest mode" - that is, scale back new development, since there will
be no market for it, and concentrate on generating cash from their existing
contracts (which is now badly needed for litigation).
Is firing all of their
developeres what they mean by driving "additional efficiencies"? [ Reply to This | # ]

This whole situation reminds me of a chess game with the stock price as a
barometer of who's winning. At first it's easy to make moves that look good;
file lawsuits, issue press releases, hire lawyers. Pawns moved forward.
But they're in the mid game now and that's when some of the ranking pieces start
falling. The stock price has been sliding since January and has been losing 7+%
each the past few days. Time to put on a good show and move out one of the
bishops for sacrifice. They're getting a little bump out of it. [ Reply to This | # ]

Maybe they should try to sell on E-Bay! In any regard, I would buy a

As far as I can tell he's half-decent in the work he's done so far (I don't
think guilt-by-association should be done with this guy working for Waste
Management any more than it should be done to former employees of Enron or
Arthur Andersen unless there is additional evidence showing the employee had
some degree of complicity), so I don't see why he'd risk his reputation when the
company is about to tank. I can see why SCO would want him. Here's an article he

Frank says the court cost for latest items could run $300 to $400 so if we are

The Street seems to be reacting to this, the stock is at 6.55 at 12:10 PM
EDT, which is lower than it's been since June 4th of 2003.

In the SCOG press release (not the second one, which is a report) the usual
"owner of UNIX" guff is conspicuous by its absence. It's also missing
from www.sco.com as of today (and maybe earlier). Someone must have got to
them.

Just because he's retired doesn't mean the feds can't go after him (remember
Jeff Skilling and Ken Lay from Enron). He'll most likely try to launder the
money he has by passing it in name to his wife and children--may be a good move,

It is said that even the rats desert a sinking ship. I don't know if Mr.
Bench is a good guy caught up in someone else's scam, and doing the sensible and
honourable thing by getting out, or a rat, but we will give him the benefit of
the doubt unless proven otherwise. Just wait for the Chief McRat to
leave, real soon now, with a bunch of lawyers in hot pursuit...... That will be

And in that article it mentions New Haven, IN. Well, I lived within 3 miles of
that landfill which is on Adams Center road (the site included chemical wastes
from other states!) I remember the political battle that ensued when New Haven
residents tried (desparately) to get WMI out of town. At least Indiana's EPA
refused their expansion! It's amazing this "company" is still in
business!
Well, we know a lot about SCO's new CFO!!! And what that says about Darl
McBride! "Birds of a feather...."

SCO's new CFO comes from WMI, who has been audited by Arthur Anderson. Remember
Enron?? That was also Arthur Anderson! Looks like that accounting firm is tied

Seems Bert was at Waste Management right around the time they, gasp, were forced
to restate their earnings way, way, way down. What's more, this action brought
on a slew of shareholder lawsuits.
Looks like SCO went for someone with relevant experience on this personnel

Am I the only one who remembers Whittman-Hart as the company that acquired
USWeb/CKS and formed that notorious, typographically challenged, dot-bomb
casualty, marchFIRST?
Divine bought the smoldering remnants of Whittman-Hart, then sold them to the

In the press announcement, they say they are a leading supplier of Unix Systems.
Are they? Based on their revenue? Aren't IBM, Sun and HP leading suppliers?
What does it take to be able to say 'leading' in a press release? Isn't this a
quasi legal document? If they are in last place of those offering Unix Systems,

I am reading "owns the rights to Unix" as different from what SCO used
to say "SCO is the owner of the UNIX® Operating System".
I am interpreting this as significantly different in a legal sense. (Maybe
related to current court cases and coming invester lawsuits?)
I would like an opinion: Is this is as significant a change as I think it is?
Is SCO changing the words because it is starting to believe it won't win the
Novell suit?

Why didn't SCO mention that Mr. Young comes most recently from LANDesk? Or Talk2
Technologies where he had experience turning VC investments into cash flow?

I used to have a shop that used WMI for garbage collection. When I closed the
shop down, they stopped pick-up 6 weeks earlier than they were supposed to,
creating much larger than expected dump-runs, yet they continued to bill me for
2 months after the shop was closed. When I disputed the charges, they said OK,
we have issued a credit, then referred the account to a collection agency.[ Reply to This | # ]
